Do I need to use my own privacy policy if Constant Contact already has one? Can I link that in the footer?

Thank you for reaching out to us through the Community. You do not need to include your privacy policy within your email campaign if you do not want to. You can if you want to include your privacy policy within your footer, however, due to legal limitations and compliance with the Canadian Anti-Spam Legislation (CASL) and the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act), one of support agents would have to make the changes within your footer. Now that everyone is updating their privacy policies to make them GDPR-compliant, do we need to update ours or does Constant Contact automatically do it?

Most users do not need to include their own privacy policy. However if you or your legal team has determined that you should include it, you may consider making some updates to that privacy policy to make sure that it's still fully compliant. We have no access or ability to change your privacy policy on your behalf I'm afraid, so that's something that will not happen automatically if it does need to happen for you.
