Segments only refresh when you prompt them to. If you schedule an email to send to a segment a week out, then manually refresh the segment an hour before the email sends, the email will send to that most recent version of the segment.
A segment with an open criteria is only going to show emails that have already been sent out, at the time of creating it. The segment will remain with this original compilation after other emails are sent, until you manually refresh it.

Would like to suggest an addition to the segmentation menu or maybe the particular email menu--could be a checkbox telling the system to refresh the segment before sending
If you'd like, you could make a post on the Feedback board regarding that type of functionality. That way the Community admins for that board can get that idea floated, and if other users are interested they can vote and voice further use cases / enhancements in a similar vein.
