Sign-Up Forms Privacy Disclaimer Design Suggestion

I suggest moving the privacy disclaimer outside of the signup box. This is very distracting and I feel it would make people question hitting the sign up button. If it is at the bottom of the page similar to how I found this "Have Feedback?" link, this would be seen and not distract or interrupt a client's desire to sign up for email updates from any business.
